Lis Pendens

Lis Pendens in real estate is a formal notice recorded in the public records indicating that a property is subject to a pending lawsuit. This legal document alerts potential buyers, lenders, and other interested parties that the property is involved in a legal dispute, which could affect the property’s title or ownership. A Lis Pendens can be filed by any party with a claim on the property, such as in cases of foreclosure, boundary disputes, or breach of contract. It effectively “clouds” the title, making it difficult to sell or refinance the property until the legal matter is resolved. The purpose of Lis Pendens is to protect the claimant’s interest in the property and ensure that any subsequent buyers are aware of the ongoing litigation.
